Andean Pact. (South America)

Introduction

The Andean Pact is a regional pact formulated by Andean Community Countries comprising of Bolivia, Colombia, Ecuador and Peru.

The Andean Pact has the following Regimes:

  1. Common Industrial Property Regime (486)
  2. Common Regime on Copyright and Related Rights (351)
  3. The Regime of Protection of Plant Breeders’ Rights (345)

These Regimes are common to the 4 countries mentioned above and offer Quick and Transparent procedures concerning the origin and protection of intellectual property rights within these countries.

The main aim of the Andean Pact is to:

  • Stop Unfair Practises
  • Curtain Unfair Competition
  • Curb Piracy and Duplicacy

Amongst the 4 member countries.

Remedies under the Andean Pact

In case of violation of any rights, the national competent authority is empowered to order the immediate cessation of the illegal activity, the seizure, forfeiture, confiscation or preventive seizure of the copies produced in violation or apparatus or means for the commission of the offense.

Conclusion

However, filing and registration of trademarks has to be proceeded individually in each country.  The Pact is only for the regulation of Intellectual Property Regimes amongst the Andean Community.
