• Trademark Registration in NORWAY

  • If the application meets all the requirements as set out in the trademarks act, the trademark shall be registered and notice of registration published.

    In the event the application does not meet the conditions as per the trademark act, the NIPO notifies the applicant about the deficiencies and the applicant given stipulated time period within which to respond to the office action.

    If and when the deficiencies are removed, the trademark application proceeds to registration and Certificate of registration issued. If the applicant does not respond to the office action, the application shall be dismissed.

    Trademark registration in Norway is valid for 10 years from the date of application after which it can be frequently renewed for another 10 years.Rights of Trademark Owners:

    Trademarks may be:

  • Pre-Registration: Use of the marks before applying for registration is advantageous since marks not sufficiently distinctive to be registrable can acquire the necessary distinctiveness through use, but generally the use must be in Norway. If the mark is recognised in the concerned trade circles, the applicant can oppose applications or apply for cancellation of registrations of the same or similar marks for the same or similar products/services.

    Post-Registration: A trademark is liable to be cancelled/deleted in full or in part owing to non-use if the mark is not used continuously within 5 yrs. from the date of registration. Usage post 5 yrs. can cure non-use provided there has been no legal action in the interim by 3rd parties.
